It is reported that on November 10, 2012, the European Commission issued a notice that at the application of the Defense Committee of the stainless steel butt welding fittings industry of the European Union, the European Commission decided to launch an anti-dumping investigation on stainless steel tube butt welding fittings originating in China. The customs codes of the products involved are 73072310 and 73072390. The investigation period of this case is from October 1, 2011 to September 31, 2012. According to the anti-dumping law of the European Commission, enterprises involved in the case must submit sampling questionnaires within 15 days from the date of filing and announcement. The deadline for sampling questionnaires in this case is November 26, 2012. The European Commission intends to select the United States as the substitute country in this case.
According to the statistical data of Minmetals chamber of Commerce, "Yuli group" including its affiliated companies Suzhou Yuli Pipe Industry Co., Ltd., Zhejiang Yuli Pipe Industry Co., Ltd., Zhejiang Zhide Pipe Industry Co., Ltd., Shanghai Jiesheng Pipe Industry Co., Ltd. and Jiangsu Yancheng Dafeng Pipe Industry Co., Ltd. ranked first in the data of products exported to the EU during the investigation period, and it is more likely to be selected as a mandatory respondent.
After many discussions, Yuli management decided to actively respond to the European Commission's investigation to obtain the best investigation results and ensure the company's export interests. It is understood that as the largest exporter of stainless steel butt weldments to Europe in China, Yuli pipe industry has a wide and profound understanding of the European market. The overall production capacity of the European stainless steel butt weldments industry is relatively low, the production cycle is relatively long, and the production cost is high, which leads to the lack of market competitiveness of the industry. On June 12, 2013, the leaders of Suzhou Yuli management and the lawyers of Beijing Yingke Law firm went directly to Brussels, where the headquarters of the European Commission is located, to participate in the hearing. Suzhou Yuli management is also the only enterprise in the process of responding to the lawsuit to hold a hearing on the investigation application in the European Commission.
In this hearing, Mr. Nicola and MS Olga stiegrad, the leader of Suzhou Yuli management, the lawyer of Beijing Yingke Law Firm, and Kenneth Davies, the EU partner lawyer of Yingke, attended the meeting. At the meeting, Suzhou Yuli pipe industry introduced the purpose of this hearing and detailed data, and claimed the irrationality of this investigation to the European Commission. With the efforts of Suzhou Yuli management and other parties, the plaintiff submitted an application for withdrawal of the case to the European Commission within 15 days after the hearing, that is, on June 27, 2013.
At present, this case is in the review period of the plaintiff's withdrawal application. In the near future, we can predict that this case will become one of the few cases of the plaintiff's withdrawal in the European Commission's anti-dumping investigation against China.
